Terms and Conditions of Sale

This page states the applicable General Terms and Conditions of Sale which govern the use and purchases made on the happyofficine.ch website.

The General Terms and Conditions of Sale define the contractual relationship between :

Happy Officine Sàrl, Sur Momont 23, 1649 Pont la Ville, Switzerland, company registered in the Commercial Register of the Canton of Fribourg under number CHE183097629.
Hereinafter referred to as "Happy Officine" or the "site"

and

Any physical person or business, using or making a purchase on the site
Hereinafter referred to as "customer".

 

1 - Conclusion of the contract

When the customer clicks on the "Order" button, the order is considered a firm order for all the items in the basket. 

In accordance with the legal provisions, the customer immediately receives a summary of the order by e-mail.

These steps form a firm order, a contract therefore takes effect immediately, the contract is governed hereby.

Nevertheless, we reserve the right to refuse an order in the following circumstances: the customer would be in dispute with Happy Officine, an estimation by Happy Officine of a risk of fraud or default of payment .

Happy Officine is not obliged to deliver the product item(s) when we are unable to obtain them from our suppliers (delivery delays, out of stock products...). In this case Happy Officine will immediately proceed to reimburse the customer.

 

2 - Prices

 

The prices indicated on the site are firm and final, they include the VAT in force.

 

3 - Deliveries

 

Orders confirmed before 1pm are normally dispatched the same day - Monday to Friday. In Switzerland, orders placed on Saturdays, Sundays and public holidays will be shipped the next business day.

Happy Officine ships orders with Swiss Post.

The times indicated on the Happy Officine site are indicative and without any commitment. Happy Officine cannot be held responsible in case of delay or failure of the transport companies.

Happy Officine reserves the right to make partial deliveries.

The customer undertakes to immediately check that the item(s) contained in the delivery are in conformity with those ordered (a complete delivery in conformity with the order, state of the articles...).

Damage to the item(s) must be reported as soon as possible (within a maximum period of 5 Days after delivery) to Happy Officine and the transport company.

3.1 - Deliveries in Switzerland

3.1.1 Tariffs

The delivery rates are as follows:

3.1.2 Time limits

The deadlines announced by Swiss Post are as follows for orders confirmed before 1:00 p.m. : 

Postpac Economy Second business day after the order has been placed
Postpac Priority Following business day after the order has been placed

For orders confirmed after 1pm, an extra business day is included.

The indicated deadlines are indicative and without any commitment. Happy Officine cannot be held responsible in case of delay or failure by the transport companies.

 

4 - Payment

 

4.1 - Methods of payment

The customer has several payment options that are displayed at the end of the ordering process:

- Payment on Invoice

- Bank Card 

- Postfinance Card 

- Paypal

- Twint

- Prepayment 

 

4.1.1 Payment by bank card and postfinance 

Orders cannot be shipped if Happy Officine is not able to debit the customer's account (invalid card number, bank refusal...).

 

4.1.2 Advance Payment 

In the case of "Advance Payment" orders, the customer must pay the amount of the order in order to initiate shipment.

No shipment of item(s) will be made without full payment of the order.

Unpaid prepayment orders are automatically deleted after 10 Days.

 

4.13 Purchase on account with partial payment option (POWERPAY)

MF Group / POWERPAY offers the payment type "Payment on account" as an independent payment service provider. You can simply pay for your online purchase by invoice. If you waive payment on time, you will receive a monthly invoice with an overview of the order retroactively the following month.

On conclusion of the purchase contract, POWERPAY takes over the invoice claim and handles the processing of the payment terms. In the case of purchase on invoice, you accept POWERPAY's GTCs in addition to our GTCs. (powerpay.ch/en/agb).

 

4.2 - Reservation of ownership

The delivered product item(s) remain the property of Happy Officine until the customer pays the full amount of the invoice relating to the order.

 

5 - Return policy

 

In the event that the customer wishes to return an item(s), the customer has a maximum period of 30 days from the date of order.

Returns are free of charge for customer deliveries in Switzerland; a shipping label will be provided by Happy Officine to the customer. It will be up to the customer to carefully pack the return item(s) and to deposit the package with the transport company.

5-1 General terms and conditions 

The customer has 30 days from the date of order to request a return.

The item(s) must not have been opened, damaged and in its original packaging.

Sale item(s) cannot be returned.

Happy Officine cannot be held responsible in case of delay, destruction or failure by the transport companies; during the return transport of a product item(s).

To request a return, the customer must utilise the contact form in his customer account and indicates the following:

- Full name, order number and date of the order
- Item(s) concerned to return

Happy Officine will provide the return address label allowing the free return of the item(s) (Switzerland only).

After verification of the returned item(s), Happy Officine will send the customer a voucher for the value of the item(s) within a maximum period of 8 days.

The voucher will be valid for a period of 3 months.

In case of a contradictory version, the General Terms and Conditions of Sale are the only conditions to be taken into account.

 

6 - Protection of personal data

 

Happy Officine undertakes to treat your personal data confidentially and to ensure its protection.

Acceptance of these General Terms and Conditions of Sale implies acceptance of our data protection policy and the collection of data necessary for the operation of the Happy Officine website.

 

7 - Promotional codes

 

As part of "One-Off" offers, Happy Officine offers promotional codes for a limited time and under limited conditions.

These promotional codes are valid only once, per customer and per order. Some products or brands may be excluded from these offers.

These promotional codes offer a partial discount on an order; the payment must be completed with the code provided, during the ordering process.

No credit notes or refunds can be made using these promotional codes. 

In case you return an item(s), the promotional code is not included with the return credit voucher.

 

8 - Purchase vouchers

 

If the customer is in possession of a voucher; generally it can be redeemed up to a maximum of 12 months BUT only 3 months in the case of a returned item(s) voucher.

Vouchers not redeemed within the above periods are lost and cannot be extended. No refunds will be made.

 

9 - Samples

For any order, the customer has the option to choose 3 samples. Depending on the available stock of samples, at the time of processing the order, Happy Officine reserves the right to substitute the customer's selection with other types of samples.

If the customer does not select samples with the order, it will be processed without.

In the instance that the customer chooses more than 3 samples, Happy Officine reserves the right to include only 3 samples from the customer's selection.

Any modifications of the samples will not give right to any claim of refund, credit note or cancellation of an order. 

 

10 - Legal liability

The legal guarantee for defective products applies.

In the case of a "Recall" of a product by a supplier or a defect that has been detected by Happy Officine between the order and the expedition. Happy Officine will exchange the product or provide a refund to the customer. 

 

11 - Applicable law

 

All clauses in these General Terms and Conditions of Sale are subject to Swiss law.
